Terms and Conditions for Creative Spaces LLC Studio Rentals

Welcome to Creative Spaces LLC! These Terms and Conditions ("Terms") govern your access to and use of our photo studio rental services. By booking or using our facilities, you agree to be bound by these Terms. Please read them carefully.

1. Introduction and Acceptance of Terms

Creative Spaces LLC provides professional photo and video studio spaces for rent. These Terms form a legally binding agreement between you ("Client," "You," or "Your") and Creative Spaces LLC ("We," "Us," or "Our"). Your use of our services signifies your complete understanding and acceptance of these Terms.

If you do not agree with any part of these Terms, you must not book or use our studio facilities. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.

2. Booking and Reservations

2.1. Booking Process: All bookings must be made through our official booking portal or by direct contact as specified on our website. A booking is considered confirmed only upon receipt of full payment or a mutually agreed-upon deposit and written confirmation from Creative Spaces LLC.

2.2. Rental Periods: Rental periods are defined in hourly, half-day (4 hours), or full-day (8 hours) increments. Any usage exceeding the booked period will be subject to overtime charges at our standard hourly rate, which may be higher than the initial booking rate.

2.3. Availability: While we strive to keep our booking calendar up-to-date, studio availability is subject to change. We are not liable for any inconvenience or loss incurred due to unavailability of a requested time slot.

2.4. Modifications and Cancellations:

• Cancellations made more than 7 days prior to the booking date are eligible for a full refund.
• Cancellations made between 3 and 7 days prior to the booking date will incur a 25% cancellation fee, with the remainder refunded.
• Cancellations made less than 3 days prior to the booking date are non-refundable.
• We reserve the right to cancel a booking due to unforeseen circumstances, such as equipment failure or facility issues. In such cases, we will provide a full refund or reschedule the booking at a mutually convenient time.

2.5. Overtime: Please adhere strictly to your booked time. If you require additional time, you must obtain prior approval from Creative Spaces LLC. Unauthorized overtime will be billed at a premium rate, and subsequent bookings may be affected.

3. Studio Usage and Responsibilities

3.1. Authorized Use: The studio is rented for photography and videography purposes only. Any other use, including but not limited to events, parties, or commercial activities not explicitly agreed upon, is strictly prohibited.

3.2. Client Conduct: Clients and their guests must conduct themselves in a professional and respectful manner. Any behavior that disrupts other clients or staff, or damages property, will not be tolerated.

3.3. Safety and Security: Clients are responsible for the safety and security of themselves and their guests within the studio premises. Please report any safety concerns immediately. Do not tamper with any electrical equipment or studio fixtures.

3.4. Prohibited Items: The following are strictly prohibited within the studio:

• Flammable materials, explosives, or hazardous substances.
• Weapons of any kind.
• Live animals, unless explicitly permitted and arranged in advance with appropriate supervision.
• Smoking (including e-cigarettes) is prohibited inside the studio. Designated smoking areas, if available, must be used.
• Excessive noise that may disturb neighboring businesses or residents.

3.5. Decor and Modifications: No permanent alterations, drilling, painting, or affixing items to walls or ceilings are permitted without prior written consent from Creative Spaces LLC. Any approved modifications must be restored to their original condition at the Client's expense.

4. Equipment and Supplies

4.1. Included Equipment: Our studio rental rates may include the use of standard equipment such as lighting fixtures, backdrops, and basic furniture. A detailed list of included equipment can be found on our website or provided upon request.

4.2. Client's Equipment: Clients are welcome to bring their own equipment. However, we are not responsible for the setup, operation, or maintenance of external equipment.

4.3. Damage to Equipment: Any damage to Creative Spaces LLC's equipment caused by the Client, their guests, or their negligence will be the sole responsibility of the Client. Repair or replacement costs will be charged to the Client at our discretion.

4.4. Backdrops: Use of backdrops is subject to availability and specific rental packages. Damage to backdrops (tears, stains, excessive wrinkles) will incur a cleaning or replacement fee.

5. Payment and Fees

5.1. Payment Terms: Full payment is required at the time of booking, or a deposit as specified by Creative Spaces LLC. Any outstanding balances are due prior to the commencement of the rental period.

5.2. Overtime Charges: As mentioned, unauthorized overtime will be billed at the prevailing hourly rate.

5.3. Additional Fees: Additional fees may apply for services such as equipment rental, specific backdrop usage, or excessive cleaning required due to misuse.

5.4. Late Payments: Payments not received by the due date may incur late fees, and future bookings may be subject to cancellation.

6. Liability and Indemnification

6.1. Limitation of Liability: Creative Spaces LLC, its owners, employees, and agents shall not be held liable for any loss, damage, injury, or death sustained by the Client or their guests while on the premises, unless such loss, damage, injury, or death is a direct result of our gross negligence or willful misconduct.

6.2. Indemnification: The Client agrees to indemnify and hold harmless Creative Spaces LLC, its owners, employees, and agents from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorney's fees) arising out of or related to the Client's use of the studio, including but not limited to any damage to property or injury to persons caused by the Client or their guests.

6.3. Insurance: Clients are strongly advised to obtain their own liability insurance to cover any potential damages or liabilities that may arise during their rental period.

7. Privacy and Data Protection

Creative Spaces LLC respects your privacy. Any personal information collected during the booking process will be handled in accordance with our Privacy Policy. We will not share your personal information with third parties without your consent, except as required by law or to fulfill your booking requests.

8. Intellectual Property

All content provided on the Creative Spaces LLC website, including text, graphics, logos, and images, is the property of Creative Spaces LLC or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or display any part of this content without our express written permission.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Creative Spaces LLC is registered. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
